The following terminology applies to this Privacy Policy Statement:

"TheSparkOne," “Ourselves,” “We,” and "Us,” refers to TheSparkOne, LLC, an Arizona limited liability company.

“You,” and “Your” refers to you, the person accessing TheSparkOne, LLC’s website and other services.

The Website” refers to the current website located at www.thespark.one. “Sparkland” refers to the mobile application that We operate.

“Our Services” refers to the Website, Sparkland, TheSparkOne Network, and any other services provided by TheSparkOne through the Website.

“This Privacy Policy” refers to this Privacy Policy that you are currently accessing and all incorporated agreements as described herein.

Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Agreement to be Bound and Modification of Policy

This Privacy Policy Statement explains how we treat your personal information and protect your privacy when you use our Services. By using our Services, you agree that we can use such information in accordance with the policies stated in this Privacy Policy. If you have any concerns with how your personal information is used, you should not use the services we provide, or you should discontinue your use and deactivate your user account if already created. We may modify this Privacy Policy at our discretion at any time. You are therefore advised to re-read this Privacy Policy on a regular basis. Any change in this Privacy Policy will be posted on the Website. Any modification will not apply retroactively and will become effective when it is posted. Your continued use of our Services constitutes an affirmative: (1) acknowledgment of the modifications; and (2) agreement to abide and be bound by the modifications. If you do not agree to any of the modified terms, you should stop using our Services immediately.

Information We Collect

We collect “Non-Personal Information” and “Personal Information.” Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks. Personal Information includes your name, address, date of birth, address, email and other contact information, which you submit to us through the registration process for the Sparkland mobile application and TheSparkOne Network. For purposes of this Privacy Policy, Personal Information may include information you submit to us regarding your business such as your business name, business address, and taxpayer identification number.

Non-Personal Information Collected via Technology

In an effort to improve the quality of our Services, we track information provided to us by your browser or by our software application when you view or use our Services, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to our Services, the time and date of access, and other information that does not personally identify you. We track this information through the use of the following:


Our Services use cookies, which are small text files stored on a hard drive or mobile device for record-keeping purposes. We use cookies to determine how many users we have and how often they use various parts of our Services. We also use cookies to personalize the services you receive as return users. We may use both persistent and session cookies; persistent cookies remain on your device after you close your session and until you delete them, while session cookies expire when you close your browser. Clear Gifs (Web Beacons/Web Bugs)

We may employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs) for our Services. These clear gifs will help us better manage content by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the movements of our users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly in our Services and are about the size of the period at the end of this sentence.

Log Files

When using our Services, we gather certain information about you automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, to administer the application, to track users’ movements and to gather demographic information about our user base as a whole. This information is not used to track individual users.

Personal Information Collected Via Registering for an Account
In addition to the Non-Personal Information collected automatically via technology, you must register an account to use Sparkland and TheSparkOne Network. To create your account, you must enter your name, date of birth, email address, a unique user name and a password. For purposes of this Privacy Policy, Personal Information may include information you submit to us regarding your business such as your business name, business address, and taxpayer identification number. By registering, you are authorizing us to collect, store and use your Personal Information in accordance with this Privacy Policy.

How We Use Your Non-Personal Information

We use your Non-Personal Information for analytical purposes, such as measuring the number of users of our Services, measuring which sections of our Services are more used, making our Services more useful to visitors and delivering targeted advertising and non-advertising content. We use this information to analyze trends, administer our Services, track a visitor’s movement, and gather demographic information for aggregate, non-personally identifiable use.

How We Use Your Personal Information

In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers. Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for TheSparkOne, such as the servers for our email communications who are provided access to a user’s email address for purposes of sending emails from us. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy.

We may share Personal Information with outside parties if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request, to enforce our Terms and Conditions (including investigation of potential violations), address fraud, security or technical concerns, or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law.

How We Store Your Information

Keeping your personal information confidential is one of our top priorities. When you enter Personal Information and other sensitive information on our registration page or other areas of our Services, we will encrypt that information to provide you added security. We will not intentionally disclose your information except in accordance with this Privacy Policy, and we will take all commercially reasonable steps to prevent the disclosure of your personal information. These measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. Special Offers and Updates

We may occasionally send you information on products, services promotions and other deals relating to services that we may make available. Out of respect for your privacy, we give you the option to unsubscribe to these types of communications.

From time to time, we may send you announcements related to our Services. These announcements will be strictly related to your use and access of our Services – for example, if our Services are temporarily unavailable for maintenance or if you request a recovery for your username and/or password. You may not unsubscribe from these service-related announcements. If you do not wish to receive them, you have the option to deactivate your user account for the Sparkland mobile application and TheSparkOne Network.

Children’s Privacy Protection

Children under the age of thirteen (13) may not use our Services. We do not knowingly collect information from children under the age of thirteen (13), nor do we share such information with third parties. If you think that your child provided this kind of information through our Services, we strongly encourage you to contact us immediately, and we will do our best efforts to promptly remove such information from our records. In the event that we learn that we have gathered personal information from anyone under the age of thirteen (13) without the consent of a parent or guardian, we will delete that information as soon as possible.

Third Party Advertisers

From time to time, we may display advertisements through our Services that are delivered to our users from our advertising partners. We may show you advertised content in several different areas of our Services. We will not share Personal Information with any third-party advertiser or ad network. Our advertising partners may use cookies and clear gifs through our Services and/or on their websites. We encourage you to read our advertising partners’ privacy policies to see how they use the information they gather.

From time to time, we may display links to other websites that are not owned or controlled by TheSparkOne. We are not responsible for the privacy practices of such websites. As stated above, this Privacy Policy applies only to information collected by TheSparkOne.

When you leave our Services and access these other websites or mobile applications, you should always read their respective privacy policies. Your use of a third-party website or mobile application will subject you to that party’s privacy policy.

Access to Your Information and Termination of Your Account

You have a right to modify or delete your Personal Information relating to your profile through navigations buttons within the Sparkland mobile application and within TheSparkOne Network. You also have the right to deactivate your account through navigation buttons within the Sparkland mobile application and within TheSparkOne Network.

Business Transitions

At some point, TheSparkOne may go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets. In the event this occurs, your Personal Information will likely be among the assets transferred. We will notify you via email or by placing a notice on our Website of any change in ownership or control of your Personal Information.

Notice to European Users

Please note that the information you enter through our Services or otherwise provide to TheSparkOne may be transferred outside of the European Economic Area (EEA), for purposes of processing, by TheSparkOne, a company located in Phoenix, AZ, its subsidiaries or its authorized partners, located worldwide, in order to provide our Services to you. You are advised that the United States uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation. You are further advised that the Council of the European Union has found that this model does not provide “adequate” privacy protections as contemplated by Article 25 of the European Union’s Data Directive. Entire Agreement

This Privacy Policy is the entire agreement between the parties and supersedes all prior agreements between the parties regarding the subject matter contained herein.
